Terms of Service

These terms govern your use of the AllHours service provided by GoopWorks LLC ("AllHours", "we", "us"). By creating an account or using the Service, you agree to them. If you are agreeing on behalf of a business, you confirm you have authority to bind it.

1. The Service

AllHours provides an AI receptionist that answers inbound telephone calls on your behalf, conducts intake you configure, may book appointments against availability in systems you connect, sends confirmations, and escalates calls according to rules you define. Features vary by plan and by the integrations you enable.

2. Not an emergency service

The Service is not an emergency service and is not a substitute for emergency responders. It does not connect callers to 911 or to any public safety answering point. You are responsible for configuring greetings and escalation rules that direct callers with life-threatening emergencies to contact emergency services directly, and for maintaining human coverage appropriate to the risks of your trade.

You acknowledge that telephony, internet and third-party AI services can fail, and that no escalation path is guaranteed to reach a person. Do not rely on the Service as the only route by which an urgent call reaches your business.

3. Accounts

You must provide accurate registration information, keep your credentials secure, and are responsible for activity under your account. Tell us promptly at help@allhours.app if you suspect unauthorized access.

4. Your responsibilities

These obligations sit with you, not with us:

  • Recording and monitoring law. You determine whether calls on your line are recorded and transcribed, and you are responsible for compliance with applicable federal and state recording and consent laws, including all-party consent requirements.
  • Messaging consent. You are responsible for having a lawful basis to send text messages to the people you or your callers add, for compliance with the Telephone Consumer Protection Act and equivalent rules, and for honouring opt-outs. Our SMS messaging terms set out the programme, the verbal consent script the receptionist follows, and the opt-out handling you must not disable.
  • Configuration accuracy. Business hours, service areas, pricing guidance, availability rules and escalation criteria are yours to define and keep current. The Service acts on what you configure.
  • Escalation coverage. You are responsible for ensuring the contacts in your escalation path are reachable and that a backup exists.
  • Your data. You are responsible for the lawfulness of information you upload or instruct the Service to collect.

5. Acceptable use

You may not use the Service to:

  • Place or facilitate unlawful, deceptive, harassing or unsolicited bulk calls or messages
  • Impersonate another business, or misrepresent the automated nature of the Service where disclosure is required
  • Collect payment card, financial account or government identification numbers through the receptionist
  • Attempt to gain unauthorized access to the Service or interfere with its operation
  • Resell or provide the Service to third parties without our written agreement

6. Fees and billing

Fees, billing period and any usage allowances are those shown on your plan at the time of purchase. Charges recur automatically until cancelled. Fees are non-refundable except where required by law or expressly stated. We may change pricing on 30 days’ notice, effective at your next renewal. You are responsible for applicable taxes.

7. Intellectual property

We retain all rights in the Service, its software and its documentation. You retain all rights in your business content and your call data. You grant us a limited licence to process that content solely to provide, secure and support the Service.

8. Availability

We aim to keep the Service available but do not guarantee uninterrupted operation. Maintenance, updates, third-party outages and network conditions can interrupt it. Any service level commitments apply only if stated in a separate written agreement.

Carrier disclaimer. Call and message delivery depends on telecommunications carriers we do not control. Carriers are not liable for delayed or undelivered calls or messages, and we are not responsible for carrier failures, routing errors or network outages.

9. Third-party systems

Integrations with scheduling software, CRMs and messaging tools are provided by third parties under their own terms. We are not responsible for their availability, accuracy or changes to their interfaces, including changes that interrupt booking.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Automated conversation and transcription are probabilistic and can be inaccurate; you are responsible for reviewing outcomes that matter to your business.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost business opportunities, or missed or mishandled calls. Our total aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim.

12. Indemnification

You will indemnify and hold us harmless from claims arising out of your use of the Service, your configuration of it, your content, and your breach of these terms or of applicable recording, consent or telemarketing law.

13. Termination

You may cancel at any time; cancellation takes effect at the end of the current billing period. We may suspend or terminate access for breach of these terms, non-payment, or activity that creates legal or security risk. On termination you may export your call records for 30 days, after which we may delete them.

14. Governing law

These terms are governed by the laws of the State of Idaho, without regard to conflict of law rules. The exclusive venue for disputes is the state and federal courts located in Kootenai County, Idaho.

15. Changes

We may update these terms. Material changes will be posted here with a revised date and, where required, notified to you directly. Continued use after changes take effect constitutes acceptance.
